1. Agreement to Terms

By accessing or using Singulariti™ (“the Platform”), operated by Makaivelli LLC (“Company,” “we,” “us”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

2. Description of Service

Singulariti is an AI-powered analysis platform that assists veterans, attorneys, and Veterans Service Organizations (VSOs) in reviewing VA disability claims files for potential errors, missed entitlements, and strategic opportunities.

IMPORTANT DISCLAIMER

Singulariti provides AI-assisted analysis for informational purposes only. We are NOT a law firm. We do NOT provide legal advice. We are NOT affiliated with the U.S. Department of Veterans Affairs or any federal agency. All outputs should be reviewed by a qualified VA-accredited attorney or claims agent before any legal action is taken.

3. User Eligibility

You must be:

·At least 18 years of age
·A U.S. veteran, the authorized representative of a veteran, a VA-accredited attorney, a VA-accredited claims agent, or a recognized VSO representative
·Authorized to upload and process the documents you submit

4. Account Registration and Security

·You are responsible for maintaining the confidentiality of your account credentials
·You must provide accurate and complete registration information
·You must notify us immediately of any unauthorized access to your account
·Multi-factor authentication (MFA) is required for all accounts processing veteran data

5. Acceptable Use

You agree NOT to:

·Use the Platform for any unlawful purpose
·Upload documents you are not authorized to possess
·Attempt to reverse-engineer, decompile, or extract our AI models, training data, or algorithms
·Use automated scraping, API abuse, or data harvesting against the Platform
·Misrepresent AI-generated outputs as the work of a human attorney
·Share, resell, or redistribute Platform outputs without authorization
·Interfere with Platform security or attempt to bypass the Human Approval Gate

6. AI-Generated Content

·All outputs are generated by AI systems and reviewed through our Human Approval Gate
·AI outputs may contain errors despite our quality controls
·Legal citations (case law, CFR, M21-1) are verified against known databases but should be independently confirmed
·Confidence scores represent the AI's assessment, not a guarantee of outcome
·You are responsible for verifying all information before filing with the VA

7. Intellectual Property

·Singulariti™, the Caveat™ agent system, and all associated technology are the exclusive intellectual property of Makaivelli LLC
·Patent Pending: MAK-005-PROV (TrOCR Deep C-File Intelligence System)
·You retain ownership of your uploaded documents and personal data
·We retain ownership of all AI-generated analysis, models, and aggregate insights
·You may not copy, reproduce, or redistribute the Platform's analysis methodology

8. Data Handling

See our Privacy Policy and Data Policy for comprehensive details on how we collect, process, store, and protect your data. Key points:

·All veteran data is encrypted at rest and in transit
·We use AEAD envelope encryption (KEK/DEK) for evidence files
·We do NOT sell veteran data to third parties
·We comply with HIPAA, 38 U.S.C. § 5701, and 38 CFR Part 1 Subpart B

9. Subscription and Payment

·Free tier: Limited scans per month
·Paid tiers: Billed monthly via Stripe
·Cancellation takes effect at end of billing period
·No refunds for partial months
·We reserve the right to modify pricing with 30 days notice

10. Limitation of Liability

To the maximum extent permitted by law:

·Makaivelli LLC shall not be liable for any indirect, incidental, special, or consequential damages
·Our total liability shall not exceed the amount you paid for the Platform in the 12 months preceding the claim
·We are not responsible for VA decisions, rater actions, or claim outcomes
·We are not responsible for errors in AI-generated analysis despite quality controls

11. Indemnification

You agree to indemnify Makaivelli LLC against any claims arising from your use of the Platform, your uploaded content, or your reliance on AI-generated analysis.

12. Termination

We may terminate or suspend your account for violation of these Terms. You may terminate your account at any time. Upon termination, your data will be retained for 90 days then permanently deleted unless legally required to retain.

13. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law provisions.

14. Changes to Terms

We may modify these Terms at any time. Continued use constitutes acceptance. Material changes will be communicated via email and in-app notification with 30 days notice.
